A coalition of Democratic states is challenging new US tariffs, arguing the measures are illegal and function as a tax on American families.

A coalition of 25 US states filed a lawsuit on Monday challenging the Trump administration's recent imposition of tariffs on dozens of countries. The duties, which range from 10% to 12.5%, were enacted in July under Section 301 of the 1974 US Trade Act. The administration claims the measures target trading partners that have failed to adequately address forced labor, but the states argue the policy is arbitrary and contrary to law.

The lawsuit contends that the administration is using forced labor as a pretext for an illegal tariff scheme, with the coalition stating the broad nature of the levies defies the stated aims of the legislation. New York Governor Kathy Hochul described the tariffs as a tax on families, while Oregon Attorney General Dan Rayfield characterized the move as an attempt to inflict chaos on businesses. White House spokesman Kush Desai defended the policy, stating the administration is using lawful authority to address practices that burden American businesses. Desai maintained that it is unreasonable for foreign countries to fail to address the importation of goods produced with forced labor.

International Reaction and Economic Impact

The tariffs cover 99.4% of US imports, according to the Office of the US Trade Representative. Several trading partners, including Brazil and Japan, have labeled the measures unjustified. China’s foreign ministry spokesperson Mao Ning described the tariffs as an excuse for political manipulation. Alex Capri, a lecturer at the National University of Singapore, noted that the lawsuit presents a formidable challenge to the levies. He cited a lack of credible evidence linking foreign forced labor practices to direct harm against US firms and suggested that the administration may eventually implement carve-outs to mitigate the impact of the tariffs.
